Legal Terms for GHFS Hosting

Last updated: 18 Dec 2025 — These Terms apply to GHFS Hosting, located in Essex / United Kingdom. They cover website usage, quotes, GDPR data protection, payments, refunds, cancellations, hosting responsibilities, uptime and legal limitations.

1. Scope of Terms

By using https://gh-fs.com or requesting services, you agree to these Terms of Use. If you do not agree, do not use the website or engage our services.

2. Quotes, Pricing & Project Scope

  • Quotes are based on the information you provide at the time of enquiry.
  • Final pricing, timelines and scope are confirmed in writing before work begins.
  • Delays caused by missing access, content or information may impact delivery.

3. Client Responsibilities

  • Provide accurate information and timely access where required.
  • Ensure you own or have rights to any supplied content (text, images, logos).
  • Avoid abusive or unlawful activity across communication channels.

4. Payments, Refunds & Cancellations

4.1 Hosting & Domains

  • Domain registrations and renewals are non-refundable.
  • SSL certificates are non-refundable once issued.
  • Hosting fees are refundable only if a service was not delivered as described.

4.2 Project Work

  • Deposits are non-refundable.
  • Work completed before cancellation remains payable.
  • Source files and credentials may be withheld until invoices are settled.

4.3 Chargebacks

Unlawful chargebacks may result in service suspension and debt recovery where legally permitted.

5. Liability Limitation

Where permitted by UK law, liability is limited to the amount paid for the relevant service. GHFS Hosting is not responsible for indirect loss, lost revenue, lost data, third-party outages, vendor failures, registrar or data-centre problems.

6. GDPR & Data Protection (UK/EU)

GHFS Hosting follows GDPR principles. We act as a Data Controller for enquiries and as a Data Processor when handling customer-owned information for support purposes.

6.1 Data Collected

  • Name, email, phone if voluntarily provided.
  • Message and project information.
  • Technical logs (IP address, browser metadata, timestamps) for security and uptime.

6.2 Lawful Basis (GDPR Art. 6)

  • Consent (contact forms)
  • Contract (quotes and service delivery)
  • Legitimate interest (security and communication)
  • Legal obligation (accounting retention)

6.3 Storage & Retention

  • Enquiries up to 24 months
  • Invoices and financial records up to 6 years
  • Technical logs as required for uptime and abuse prevention

7. Data Processing Commitments

  • We process customer data only under documented instruction.
  • Essential third-party vendors (hosting / email delivery) may access minimal data.
  • Data is deleted or returned on service termination unless retention laws apply.
  • Customers remain responsible for the legality of data they provide.

8. Security, Abuse & Acceptable Use

  • No phishing, spam blasting or malware distribution.
  • No DDoS, scanning, probing or attacking infrastructure.
  • No illegal media, copyright abuse or unlawful data.
  • We reserve the right to suspend or refuse service for abuse.

9. Hosting, Uptime & SLA Commitment

Hosting is operated on a commercially reasonable basis. Monthly target uptime is 99%, excluding data-centre outages, DDoS, third-party network failures, power events or force majeure. Emergency maintenance may occur without notice.

10. Backups & Data Safety

Unless a paid backup plan is included, customers are responsible for their own data. GHFS Hosting is not liable for customer-side deletion or data corruption outside our control.

11. Force Majeure

We are not responsible for delays or failures caused by natural events, grid failure, war, regulatory orders, power disruption or network-level collapse.

12. Indemnity

Clients indemnify GHFS Hosting against claims involving IP misuse, illegal content, regulatory breaches or losses caused by client activity.

13. Dispute & Jurisdiction

We encourage amicable resolution. If required, disputes fall under the authority of the Courts of England & Wales.

14. Updates to These Terms

These Terms may be updated occasionally. The latest published version applies.
